DWI Lawyer in New Jersey — Municipal Court, Interlock Penalties and Refusal Charges

By the American Counsel legal team · Updated October 2026

New Jersey treats DWI differently from most states. It is a motor vehicle offense heard in municipal court, without a jury. A DWI lawyer in New Jersey helps you navigate that system and limit the penalties.

New Jersey reformed its DWI penalties in 2019. Now, many first offenders face an ignition interlock rather than a long license suspension. However, penalties still rise sharply with higher BAC and repeat offenses. Therefore, understanding the tiers is essential.

Our attorneys prepare DWI defense packs and mitigation packets for municipal court cases across New Jersey.

New Jersey DWI law basics

New Jersey's DWI law is N.J.S.A. 39:4-50. You can be charged with a BAC of 0.08 or more, or if you are under the influence of alcohol or drugs.

DWI is a traffic offense, not a crime, in New Jersey. As a result, cases are heard in municipal court by a judge, with no jury. However, the penalties are still serious, and a conviction appears on your driving record.

Refusal is a separate offense

Refusing a breath test is a separate offense under N.J.S.A. 39:4-50.4a. It carries its own penalties, often similar to a DWI. Consequently, many people face both charges.

Penalty tiers after the 2019 reform

Penalty ranges change and depend on the facts, so treat the figures here as a general guide and confirm them for your case.

For a first offense with a BAC between 0.08 and 0.10, penalties typically include an ignition interlock for a few months, fines and 12 to 48 hours at the Intoxicated Driver Resource Center. Meanwhile, a BAC of 0.10 or more brings a longer interlock period and higher fines.

At 0.15 or more, a first offense brings a license forfeiture of several months followed by an interlock period. Furthermore, the Motor Vehicle Commission imposes insurance surcharges for several years.

Repeat offenses

A second offense brings a longer license forfeiture, a longer interlock period, mandatory jail time and community service. A third offense brings an eight-year forfeiture and up to 180 days in jail. However, New Jersey has a "step-down" rule: if ten years pass between offenses, the later offense may be treated as a lower-level offense for sentencing.

Defenses in New Jersey DWI cases

Defenses often focus on the breath test instrument and procedures. New Jersey uses specific testing devices, and the state must follow strict rules. For example, the operator must observe the driver for a set period before testing.

Other defenses challenge the stop and the arrest. Furthermore, video from police vehicles and stations can be decisive. Our DUI Defense Pack reviews the evidence and procedures.

Municipal court and appeals

DWI cases are heard in the municipal court of the town where the arrest happened. Each town has its own court and schedule. Therefore, local practice matters.

If convicted, you can appeal to the Superior Court, Law Division, which reviews the case de novo on the record. Consequently, the municipal court record should be thorough.

Mitigation and reinstatement in New Jersey

If a conviction is likely, mitigation helps. Completing an alcohol evaluation and treatment early shows responsibility. In addition, community support letters help.

Our DUI Mitigation Packet and character letters services prepare these materials. Afterwards, our license reinstatement service explains interlock installation, MVC restoration and surcharges. For more, read our national guide to multiple-offense and felony DUI.

A typical New Jersey DWI timeline

First, the arrest and summonses are issued. Next, the first municipal court appearance is scheduled. Then discovery, including breath test records and video, is requested.

After that, the case moves to motions, negotiations or trial before the municipal judge. Meanwhile, completing an evaluation early can help. Finally, the judge decides and imposes penalties. Consequently, preparation in the first weeks shapes the result.

The true cost of a New Jersey DWI

Fines are only part of the cost. In addition, expect court costs, Intoxicated Driver Resource Center fees, ignition interlock installation and monthly fees, and Motor Vehicle Commission insurance surcharges for several years. Moreover, private insurance premiums usually rise.

There are hidden costs too. For example, a DWI can affect jobs that require driving and some professional licenses. Similarly, commercial drivers face strict disqualification rules.

Consequently, a fixed-fee defense pack is a small investment compared with the long-term cost of a conviction. Furthermore, it helps you understand the evidence before your first court date.

Commercial drivers in New Jersey

Commercial drivers face stricter rules. A BAC of 0.04 or more in a commercial vehicle is a DWI. Furthermore, a DWI in any vehicle usually disqualifies a CDL holder for at least a year, and a second can mean lifetime disqualification. Therefore, CDL holders should get advice right away.
