A California DUI arrest starts two cases at once. One is the criminal case in Superior Court. The other is the DMV license case, and its deadline is very short. This guide from a DUI lawyer in California perspective explains both, so you can protect your license and your record.
California's DUI laws are strict, and penalties increase sharply for repeat offenses. However, many cases have real defenses, and good preparation can change the outcome. Therefore, the first ten days after arrest are critical.
Our attorneys prepare DMV hearing materials, DUI defense packs and mitigation packets for cases across California. As a result, you get organized help at a fixed price.
California DUI law basics
California's main DUI laws are Vehicle Code sections 23152(a) and 23152(b). Section 23152(a) covers driving under the influence of alcohol or drugs. Meanwhile, section 23152(b) covers driving with a blood alcohol concentration of 0.08% or more. Usually, prosecutors charge both.
Lower limits apply in some cases. For example, commercial drivers face a 0.04% limit, and drivers under 21 face zero-tolerance rules. In addition, DUI causing injury is charged under section 23153 and can be a felony.
Implied consent
By driving in California, you agree to a chemical test after a lawful DUI arrest. Refusing brings separate license penalties and can be used as evidence. Consequently, refusal cases need careful handling.
The 10-day DMV hearing deadline
After a DUI arrest, the officer usually takes your license and gives you a temporary permit. You then have only 10 days to request a DMV Administrative Per Se hearing. If you miss it, the suspension takes effect automatically.
The DMV hearing is separate from court. It focuses on narrow questions: whether the officer had reasonable cause, whether you were lawfully arrested, and whether your BAC was 0.08% or more or you refused. Moreover, the hearing can reveal useful evidence for the criminal case.
Our DMV Hearing service prepares your request and hearing arguments, starting at $99. Therefore, act within the 10 days.
California DUI penalties
Penalty ranges change and depend on the facts, so treat the figures here as a general guide and confirm them for your case.
A first-offense DUI is usually a misdemeanor. Penalties typically include three to five years of informal probation, fines and assessments, a licensed DUI program and a license suspension. In addition, an ignition interlock device may allow restricted driving.
A second DUI within ten years brings mandatory jail time, a longer DUI program and a longer suspension. Similarly, a third within ten years brings more jail and a longer program. Furthermore, a fourth DUI within ten years can be charged as a felony.
Ignition interlock
California law requires ignition interlock devices for many repeat offenders and for DUIs causing injury. For first offenders, an interlock often allows a restricted license sooner. As a result, it can keep you driving to work.
Defenses and plea options in California
Every DUI has potential weaknesses. For example, the stop needs reasonable suspicion, and the arrest needs probable cause. In addition, breath machines must be calibrated and maintained, and blood samples need proper handling.
Rising blood alcohol is another defense. Your BAC may have been lower while driving than at the later test. Moreover, medical conditions can affect breath results.
Wet reckless
Sometimes prosecutors offer a reduction to "wet reckless" under Vehicle Code section 23103.5. It carries lighter penalties than a DUI. However, it still counts as a prior if you get another DUI within ten years. Our DUI Defense Pack reviews the evidence and the likely offers.
Mitigation and the Watson advisement
If a conviction is likely, mitigation matters. Enrolling early in a DUI program, attending support meetings and showing a clean record since the arrest all help. Our DUI Mitigation Packet organizes these for the court.
California courts also give a "Watson advisement" on conviction. It warns that a future DUI causing death could be charged as murder. Consequently, the stakes of any later offense rise sharply.
Afterwards, our license reinstatement service guides you through SR-22 insurance and DMV requirements. For the national picture, read our national guide to multiple-offense and felony DUI.
