DUI Lawyer in Pennsylvania — BAC Tiers, ARD, Refusals and Repeat Offenses

By the American Counsel legal team · Updated October 2026

Pennsylvania punishes DUI based on how high your blood alcohol was and how many prior offenses you have. This guide from a DUI lawyer in Pennsylvania perspective explains the tiers, the ARD program and how refusals work.

Many first offenders in Pennsylvania can avoid a conviction through ARD. However, eligibility is not automatic. Moreover, refusals bring separate license penalties from PennDOT. Therefore, understanding your options early is essential.

Our attorneys prepare DUI defense packs, license appeal materials and mitigation for cases across Pennsylvania.

Pennsylvania DUI tiers

Pennsylvania's DUI law, 75 Pa.C.S. § 3802, uses three BAC tiers. General impairment covers 0.08 to just under 0.10. High rate covers 0.10 to just under 0.16. Highest rate covers 0.16 and above.

Drug DUIs and test refusals are generally treated like the highest tier. Consequently, refusing a test can bring heavier criminal penalties than a moderate BAC.

Penalty ranges change and depend on the facts, so treat the figures here as a general guide and confirm them for your case.

First-offense penalties

A first general impairment DUI often brings probation, a fine, alcohol safe driving school and treatment if recommended, usually without a license suspension. However, high and highest tier first offenses bring mandatory jail and license suspension.

ARD for first offenders

Accelerated Rehabilitative Disposition, or ARD, is a diversion program for many first-time DUI offenders. If accepted and completed, the charges are dismissed and the record can be expunged.

ARD usually requires classes, treatment if recommended, community service and fees. In addition, a license suspension may apply depending on BAC. Each county's district attorney decides eligibility. Therefore, cases with injuries or aggravating factors may not qualify.

However, ARD still counts as a prior offense for some purposes if you are arrested again within ten years. Consequently, weigh it carefully. Our DUI consultation reviews whether ARD fits.

Refusals and PennDOT suspensions

Refusing a chemical test brings a civil license suspension from PennDOT, separate from the criminal case. For a first refusal, the suspension is typically one year.

You can appeal the PennDOT suspension to the county Court of Common Pleas. The appeal deadline is short, usually 30 days from the notice. Our license hearing service prepares the appeal. Therefore, act quickly.

Repeat offenses in Pennsylvania

Pennsylvania looks back ten years for repeat DUI sentencing. A second or third offense brings mandatory jail, longer suspensions and ignition interlock requirements. Furthermore, certain repeat offenses at the highest tier can be charged as felonies.

Our felony DUI consultation reviews how prior offenses are counted.

Defenses in Pennsylvania DUI cases

Every impaired-driving case has potential weak points. First, the traffic stop needs reasonable suspicion. Second, the arrest needs probable cause. Third, chemical tests must follow strict procedures.

For example, breath instruments must be properly maintained and calibrated, and operators must follow observation periods. Similarly, blood samples require proper collection, storage and chain of custody. Field sobriety tests can be affected by weather, footwear, injuries and medical conditions.

The two-hour rule

Pennsylvania generally requires the chemical test within two hours of driving, unless the prosecution shows good cause. Consequently, test timing can be an important issue.

Video is often decisive. Dashcam, bodycam and booking footage may contradict the written report. Therefore, request it early. Our DUI Defense Pack reviews the stop, the tests and the procedures, starting at $199.

The true cost of an impaired-driving conviction in Pennsylvania

Fines are only part of the cost. In addition, expect court costs, alcohol education or treatment, ignition interlock fees where required, and reinstatement fees. Moreover, insurance premiums usually rise sharply, and an SR-22 filing is often required.

There are hidden costs too. For example, a conviction can affect jobs that require driving, professional licenses and immigration status. Commercial drivers face strict rules: a 0.04 limit in commercial vehicles and, usually, at least a one-year CDL disqualification for an offense in any vehicle.

Consequently, a fixed-fee defense pack is a small investment compared with the long-term cost of a conviction. If a conviction is likely, our DUI Mitigation Packet and character letters services help the court see the full picture. Afterwards, our license reinstatement service explains the steps back to driving. For more, read our national guide to multiple-offense and felony DUI.

What to do in the first week after a Pennsylvania DUI arrest

The first week matters most. First, write down everything you remember about the stop, the tests and the arrest, while it is fresh. Next, keep every piece of paperwork the officer gave you, especially any license notice.

Then act on the license deadline. In Pennsylvania, that means you should appeal any PennDOT refusal suspension within about 30 days. Missing it can cost your license automatically. Meanwhile, ask about ARD early, because the district attorney decides eligibility.

Finally, avoid discussing the case on social media or with anyone except your attorney. Consequently, you protect both your license and your defense from the start.

A typical Pennsylvania DUI case timeline

Every case is different, but most follow a similar path. First, the arrest and license notice happen on the same day. Next, the license deadline runs in the first days or weeks.

After that, the criminal case begins in magisterial district court for the preliminary hearing, then the county Court of Common Pleas. Discovery, including test records and video, is requested. Then negotiations, motions or trial follow over several weeks or months.

Finally, the case ends in a dismissal, a reduced charge, a diversion outcome where available, a plea or a verdict. As a result, early organization shapes every later step.
