Massachusetts limits state involvement in civil immigration detention more than most states. However, ICE still detains people, often in facilities outside the state. This guide from an ICE bond lawyer in Massachusetts perspective explains what families should expect.
Detained people from Massachusetts may be held in New Hampshire, other New England states or further away. Therefore, families must track the person carefully and identify the right court.
Our attorneys prepare bond packets, parole requests and emergency case reviews for Massachusetts families.
Where ICE holds people from Massachusetts
Massachusetts has limited ICE detention capacity. Some county facilities have held detainees, but contracts have changed over time. Consequently, people are often held in New Hampshire or other states.
The ICE Boston field office covers New England. Use the ICE Online Detainee Locator and contact the Boston office. Keep checking for transfers.
Massachusetts immigration courts and the First Circuit
Massachusetts has immigration courts in Boston and Chelmsford. Detained cases may be heard by the court covering the detention facility, often by video. Therefore, confirm the court before requesting bond.
Massachusetts is in the First Circuit. The First Circuit has addressed bond hearing procedures in detention cases. As a result, First Circuit law can be important in federal challenges.
Recent bond eligibility changes
In 2025, the Board of Immigration Appeals held that many people who entered without inspection are not eligible for bond from an immigration judge. However, federal courts, including in the First Circuit, have been considering challenges, often through habeas petitions. Therefore, an early ICE detention case review should check bond, parole and federal court options together.
The Lunn decision and state cooperation
In Lunn v. Commonwealth (2017), the Massachusetts Supreme Judicial Court held that Massachusetts court officers cannot hold someone solely on an ICE detainer once they are otherwise entitled to release. As a result, state-level detainer holds are limited.
However, ICE can still make arrests directly. Furthermore, some local practices vary. Therefore, families should prepare an emergency plan. Read our guide to crimigration for criminal case issues.
What families in Massachusetts should do in the first 48 hours
The first two days matter most. First, write down the person's full name, date of birth, country of birth and A-number if known. Next, search the ICE Online Detainee Locator, and check again later, because transfers take time to appear.
Then gather documents. Passports, immigration papers, proof of address, tax returns and any court records will all be needed. Meanwhile, keep a log of every call to ICE and every conversation with officers.
Protect the detained person's rights
Detained people are sometimes asked to sign forms, including voluntary departure or stipulated removal documents. Signing can end their case. Consequently, they should not sign anything they do not understand. Our ICE Detention Help service explains rights and next steps.
Care for the family
Finally, arrange care for children and keep bills paid. In addition, make sure someone has access to important documents. As a result, the family stays stable while the case moves forward. For urgent situations, book an emergency immigration consultation.
Building a strong bond packet in Massachusetts
A bond hearing is short, so the written packet does most of the work. It must show the person will attend every hearing and is not a danger to the community.
The sponsor
First, choose a sponsor with lawful status and a stable Massachusetts address. The sponsor signs a declaration promising to house the person and help them attend court. Moreover, include the sponsor's ID, proof of status, lease or mortgage, and proof of income.
Ties and character
Next, gather evidence of roots in the community. For example, include birth certificates of U.S. citizen children, a marriage certificate, tax returns and employer letters. In addition, letters from faith leaders, teachers and neighbors help, each signed, dated and with contact details.
Criminal records
If there is any arrest or conviction, include certified court dispositions and proof that sentences were completed. Judges notice missing records, so address them directly.
Out-of-state detention
If the person is held in New Hampshire or elsewhere, the bond hearing may be held there. However, emphasize the Massachusetts home, job and family ties.
Our Immigration Bond Hearing service assembles all of this into a motion, declarations and an indexed evidence packet, starting at $399.
Paying the bond and getting released in Massachusetts
Once bond is set, the obligor pays it to ICE, usually through ICE's online bond system or at an ICE office. The obligor must have lawful status and keep their address updated. Alternatively, some families use a surety bond company, which charges a non-refundable premium.
Releases from out-of-state facilities can happen at short notice. Consequently, arrange transport home in advance.
Our ICE Bond Posting service guides the obligor through payment, forms and the eventual bond cancellation. If bond is not available, our ICE Release / Parole Request service prepares a humanitarian request, for example for medical needs or young U.S. citizen children.
After release
The removal case continues after release. Therefore, update addresses with the immigration court and ICE immediately, and attend every hearing and check-in. If the case is assigned to a distant court, a change of venue may move it closer to home. Next, plan the defense with our guide to deportation defense, or read our national guide to ICE bond and detention release.
